Civil
Litigation involves the resolution of disputes or claims between
individuals, companies, local authorities and government departments
by the Court.
Such matters generally fall
into two categories, either based upon contract (being an
agreement between two or more parties) or a civil wrong caused
by one party to another, either negligently or deliberately.
The range of contractual
disputes can involve relatively small amounts relating to
such matters as consumer problems and small claims cases,
to multi million pound claims arising from breach of contract,
for example, building disputes. Civil wrongs also include
cases involving claims for damages for personal injury (see
separate page) and damage to property or reputation.
We can advise you upon all
aspects of civil litigation including your chances of success
and the value of possible damages. We can negotiate on your
behalf and, if necessary, commence or defend Court proceedings
(including counter-claims) which, according to the amount
in dispute, will be dealt with in either the County Court
or the High Court.
Funding
of your Case
Community
Legal Services Funding may be available to private individuals
to take or defend such proceedings, subject to eligibility.
Alternatively, it may be possible to obtain “After the
Event” legal expense insurance cover in respect of your
own and your opponent’s costs, should your claim be
unsuccessful.
